We just obtained a $5,000,000 settlement for our client’s family. Our client was a Mom of 43 years old who had cancer go untreated for over a year after the negligence of a NY hospital. Radiologists missed obvious cancer in our client’s test results, and she ultimately died. This law suit settlement will help her husband raise their children.

The New York personal injury law firm Pegalis & Erickson, LLC announces that we have secured a $10 million dollar settlement in the Supreme Court for Bronx County . A 21 year-old Bronx immigrant walked into the hospital for surgery. He left the hospital unable to move from the waist down. His life-long paraplegia was the result of avoidable medical negligence . Trial team Steven Pegalis, James Baydar and Sanford Nagrotsky argued that the doctors and hospital failed to properly monitor our client during surgery. It was our contention that the defendants departed from the standard of care utilizing unqualified monitoring technics and personnel during surgery, and did not have a qualified physician supervising the process. Our attorneys obtained him a $10 million dollar settlement following this long and complex case.

We recently obtained a settlement of $7.5 million dollars for a Pennsylvania child who was discharged prematurely from a hospital emergency department.


August 2017

We successfully resolved a heart-breaking case for the children of a Nassau County woman. She died soon after giving birth to twins. We obtained a $3.75 million dollar settlement, after hospital personnel failed to treat the woman’s breathing difficulties.


March 2017

Founding partner Steve E. Pegalis recently had an article published. Entitled “Perinatal Brain Injury: The Rights of the Disabled Child,” it appears in the NYS Trial Lawyers Bill of Particulars Magazine.

Our recent settlements for clients included the following:

We obtained a $6 million dollar settlement for an Upstate New York brain injured child, because medical care providers’ failed to treat his mother’s high blood pressure, causing a premature delivery. Then doctors failed to treat the baby’s signs of hydrocephalus, resulting in his permanent brain injuries.

We obtained a settlement of more than $3 million dollars for the family of a deceased 50-year old Suffolk County, NY man. His death resulted from his cardiac arrest due to an excessive amount of IV fluid, shortly after gall bladder surgery.

Our Nassau County, NY client was awarded a $550,000 settlement after he sustained nerve damage from the removal of a benign shoulder tumor.

We secured a $6.4 million dollar settlement for a young New York boy. He lives with permanent, severe, and multiple physical damages, as well as psychological trauma, because a hospital failed to diagnose his pneumonia in the ER, which led to sepsis and toxic shock.

A Westchester County, NY woman, who lives with pain and physical limitations, received a $900,000 settlement. After she had an arthroscopic surgery to her knee, it became infected, which lead to a total knee replacement surgery.

In November 2016 two of our attorneys were honored at separate events, for their dedication to Long Island communities.

Our partner, James B. Baydar, Esq. was presented with a Leadership in Law awards event where there were more than 300 attendees. The awards event was hosted by the Long Island Business News on November 17 in Woodbury, NY. James Baydar was recognized for his leadership having a positive impact, and his outstanding achievements. Baydar advocates for clients through complex and contentious court proceedings, in the years following successful resolution of their cases. He provides legal counsel on preserving and best utilizing clients’ verdict awards and settlement funds to pay for their lifetime. Gary M. Nielsen, Esq. accepted a 2016 Champions for Families Award from RotaCare NY on November 17 at an event held at the Mercer School of Theology. The nonprofit serves uninsured people living in poverty, with free health care screenings, exams, and medications by an all-volunteer crew of healthcare professionals. Nielsen is an attorney with more than 30 years of experience as a trial and appellate advocate, and has represented hundreds of clients, including many victims of avoidable medical errors. He maintains the highest “AV” rating from Martindale Hubbell and has since 1999, in peer recognition of his legal ability, ethics, judgment and experience.


June 2016

In June 2016, the entire firm attended the Nassau County Women’s Bar Association Annual installation dinner, as colleague Linda Oliva, Esq. was sworn in as (volunteer) President on the executive board of the Nassau County Women’s Bar Association (NCWBA). Ms. Oliva will serve a one year term as President for the 2016-2017 year.
