• Chalk One Up For Women In Law! Jenny Rivera Nominated to the New York State Court of Appeals

    Chalk one up for women in law! Governor Andrew Cuomo yesterday nominated Jenny Rivera, a CUNY Professor of Law, with no prior experience as a judge, to fill a state Court of Appeals seat!

    If confirmed by the state Senate, she will become the second Hispanic to sit on the Court of Appeals. Cuomo’s office praised Rivera, 51, as a defender of legal rights of all New Yorkers who would “make our state a fairer, more just place to live.” Rivera was a special deputy state attorney general for civil rights when Cuomo was attorney general in 2007 and 2008. Since 2008, she has been a CUNY Law professor and founder and director of the school’s Center on Latino and Latina Rights and Equality.

    An article published by ModernHealhcare.com recently outlines the new privacy rule that was released on January 17th, 2013. The new rule expands the liability of business associates of hospitals, physicians, and other HIPAA-covered entities if they release data in certain ways that violate patient privacy.

    Kathleen Sebelius, the U.S. Dept. of Health and Human Services Secretary, commented on the rule saying, “The new rule will help protect patient privacy and safeguard patients’ health information in an ever-expanding digital age.”

    A new U.S. study published by Critical Care Medicine reveals that patients are rarely told about mistakes with their medicines, an announcement that is likely to come as a big surprise to most patients and families. The researchers relayed that most medication mistakes did not harm patients, but those that did were more likely to happen with ICU (intensive care units) patients and their families.

  • Pegalis and Erickson Medical Malpractice Case Featured in the NY Daily News

    Pegalis and Erickson secured a $5.3 Million settlement for Deidre Thompson, who suffered medical malpractice during the birth of her son Sebastian. Sebastian was born with a heart rate of over 200 beats per minute and was not breathing on his own. He was also having seizures and a later CT scan of his brain showed a skull fracture and bleeding. Today, Sebastian is permanently disabled and has difficulty walking and speaking.
